Trucked Ltd – Terms & Conditions of Sale

1. Definitions
· "Company" means Trucked Ltd.
· "Customer" means the person or business purchasing goods from the Company.
· "Goods" means all truck, trailer and commercial vehicle parts supplied by Trucked Ltd.
· "Contract" means the agreement between Trucked Ltd and the Customer for the sale of Goods.
2. Acceptance of Terms
By placing an order with Trucked Ltd, the Customer agrees to these Terms & Conditions. Any differing terms proposed by the Customer shall not apply unless agreed in writing by Trucked Ltd.
3. Orders
· All orders are subject to acceptance by Trucked Ltd.
· Orders may be placed in-store, by telephone, email or via our website (where applicable).
· Trucked Ltd reserves the right to refuse or cancel any order.
4. Pricing
· All prices are shown exclusive of VAT unless otherwise stated.
· VAT will be charged at the prevailing UK rate.
· Prices may change without prior notice.
· Quotations are valid for 30 days unless otherwise specified.
5. Payment
Unless otherwise agreed:
· Payment is due at the time of purchase.
· Trade account customers must pay within agreed credit terms.
· Late payments may incur interest under the Late Payment of Commercial Debts (Interest) Act 1998.
· Trucked Ltd reserves the right to suspend future deliveries where payment is overdue.
6. Delivery
· Delivery dates are estimates only.
· Trucked Ltd will not be liable for delays caused by suppliers, couriers or circumstances beyond our control.
· Risk passes to the Customer upon delivery.
· Customers must inspect deliveries immediately and report shortages or damage within 48 hours.
7. Collection
Customers collecting goods are responsible for ensuring the correct items are received before leaving our premises.
8. Returns
Unused goods may be returned within 30 days of purchase provided:
· They are in original packaging.
· They are in resaleable condition.
· Proof of purchase is provided.
The following cannot normally be returned:
· Electrical components that have been fitted.
· Special order items.
· Non-stock items.
· Goods damaged after delivery.
· Items specifically ordered to customer specifications.
A restocking charge may apply to special order returns.
9. Warranty
Goods are supplied with the benefit of the manufacturer's warranty where applicable.
Trucked Ltd will assist customers in processing warranty claims but cannot guarantee approval by the manufacturer.
Warranty does not cover:
· Incorrect fitting
· Misuse
· Wear and tear
· Accident damage
· Modification of parts
10. Product Information
Whilst every effort is made to ensure compatibility, the Customer is responsible for confirming the correct part before fitting.
Where registration numbers or VINs are used to identify parts, these are supplied as guidance only.
11. Retention of Title
Ownership of goods remains with Trucked Ltd until payment has been received in full.
Until ownership transfers, the Customer shall:
· Store goods separately where possible.
· Keep goods identifiable as Trucked Ltd property.
· Not sell or dispose of goods without authority.
12. Limitation of Liability
To the maximum extent permitted by law, Trucked Ltd shall not be liable for:
· Loss of profit
· Loss of business
· Vehicle downtime
· Consequential or indirect losses
Nothing in these Terms excludes liability for death or personal injury caused by negligence or any liability that cannot legally be excluded.
13. Force Majeure
Trucked Ltd shall not be liable for failure to perform obligations due to events beyond its reasonable control including:
· Supplier shortages
· Transport disruption
· Industrial action
· Fire
· Flood
· Acts of God
· Government restrictions
14. Privacy
Customer information will be handled in accordance with applicable UK data protection legislation and our Privacy Policy.
15. Governing Law
These Terms & Conditions are governed by the laws of England and Wales.
Any disputes shall be subject to the exclusive jurisdiction of the English courts.
16. Trade Account Terms
Trade account holders agree that:
· Credit facilities may be withdrawn at any time.
· Credit limits are subject to review.
· Overdue accounts may be placed on stop.
· Collection costs and legal fees incurred in recovering unpaid debts may be charged to the Customer where permitted by law.
